According to Spain’s AS, prosecutors have formally filed charges in the alleged sexual assault case involving Elche forward Rafa Mir, requesting the court to sentence him to 10 years and 6 months in prison for aggravated sexual assault and assault causing injury.

The case dates back to September 2024, when Mir was on loan at Valencia CF. According to the prosecution, Mir sexually assaulted a 21-year-old woman at his private residence.

In their sentencing recommendation, prosecutors detailed the requested penalties. First, for the rape charge, prosecutors allege that Mir committed aggravated sexual assault on two occasions against the victim’s will, and are seeking 9 years in prison. Second, for the physical injuries suffered by the victim, prosecutors are requesting an additional 1 year and 6 months in prison.

In addition, prosecutors are asking that Mir pay €64,000 in compensation to the victim for both physical and psychological damages.

On September 3, 2024, Mir was arrested by police on suspicion of sexual assault. According to the complainant—a 25-year-old woman—she and another 21-year-old friend were sexually assaulted at Mir’s home. The case also involves another man, who was arrested shortly after the incident.

For Mir, this marks the darkest period of his career so far. In addition to the criminal case, he has recently been embroiled in another controversy after Espanyol player Hilali publicly accused him of making racist remarks.

Despite the mounting legal troubles, Mir appeared unusually calm during an interview with AS on January 31 this year.
